An individual reported a license plate number to the Colorado State Patrol. The report indicated someone was driving erratically on I-25 near Denver. The license plate number matched that of my vehicle that was recently totaled. I no longer have the vehicle attached to the license plate number in question nor the license plates since they were destroyed when said vehicle was totaled in an accident on 12/7/07. Yet the CSP officer decided that despite the fact I no longer had the vehicle or license plates in my possession that I must be guilty of driving drunk since I answered the door with an open beer in my hand. I had just gotten home from work, am over 21 and was not contributing to anyone's delinquency. I was thinking one of my neighbors was popping by for a cold one, but it was a law enforcement officer knocking on my door instead instead.

I calmly but firmly pointed out to the "law enforcement" officer that:
A) The only vehicle in my garage, my new Toyota SUV, did not match the vehicle reported. A blue RAV4 does not look like a silver late model Japanese (probably) sedan. And,
B) I have temp tags on the new vehicle and they did not match up in any way to my old, and allegedly destroyed, license plates.

The arresting officer is some kind of prohibitionist NAZI and considered me guilty even though I was never observed driving in my one and only vehicle under the influence. She made a poor decision based on her bias and had no facts to support her decision to arrest me. In fact, all I did was come from work on a Friday and changed into comfy clothes and opened up a beer in the privacy of my home and then answered my door when someone rang my doorbell.

I have filed a formal complaint with CSP and with the District Attorneys for Denver and Adams Counties. I lost 4 days of my life due to overzealous law enforcement based on a anonymous accuser who apparently is unwilling to testify in open court. It could be that they made a mistake, but I may never get to face my accuser. My legal counsel believes that my DUI and resisting arrest charges will be dropped but my license was taken away and may be not re-instated for another 30 days while the case wends it way through the system. I did nothing wrong. I protested my arrest vociferously, I live alone, there was no one who knew what happened to me for over 48 hours. I spent time in a county jail and bunked with a person who accused of murdering 3 people -- not exactly a good night's sleep for yours truly. I have never received any sort of DUI or DWI during 34 years of driving legally on North American roads or any place for that matter.

This is the land of freedom and justice?

What happened is a travesty and should not be let go lest history repeat itself, as it always does. Public apologies, monetary compensation and a whole bandwagon of things I can't even think of should take place. Our "America" is quickly becoming a place that is nothing to take a whole lot of pride in. Sorry Prank.

Wow! I thought to get a DUI you had to be SEEN by an officer doing such. Hell, I could pick some random tag & report such myself. Would they arrest the person based on just an anon phone call? Evidently, yes. Then to stick you in a cell with a murderer! This is insane!
I hope when you go to court the CSP office that arrested you will be reprimanded - to YOUR satisfaction. You should get a public apology in writing AND be awarded something for pain, suffering, defamation of character, etc. I'm sure you missed time from work due to this too.

I had somebody do that to me in the middle of my divorce and nasty custody battle nonetheless which caused me a lot of heartache, and even though trumped up, it ultimately affected the case. You are GUILTY until proven innocent unfortunately, it's THEIR word, not YOURS. It sucks big time, and what a blow to your morale as well. It was a horrible time. My heart goes out to you, Prank.

Holy Cow! I am so sorry to hear that, buddy. But it sounds like you have a good case to open up a can of whoopass on some people. My father had always taught me to be diligent about not letting old plates get in the wrong hands - to personally destroy them in the event my vehicle was no longer mine, and here I thought he was just being paranoid

Prank, I commented once and thankfully I returned because for some reason it isn't showing and I wanted you to know how offended I am that a system set up to protect us has brought a good friend down. Please know that I am ever so sorry that you suffered in this manner and I am quite angry at the fact that you even have to defend yourself and WAIT for your driver's license? Come on!
Prank, I hope justice is finally served and you get compensated for the wrong that was done.
48 hours and no one knew, that is wrong, you best line up a way for you to not have that happen again, I know that could have been me in my single years.

When my Mom's car got to the point of no return, she allowed the garage that she had dealt with handle the entire junking of it including the return of her plates for destruction. I thought it odd that she didn't receive the notice that we get when we turn in plates but so much was going on that I just didn't follow up on it.

The garage or someone that worked there either loaned the plates or sold the plates and someone passed through the thruway EZ pass without paying down on Long Island, NY, in a silver colored car with her plates on it. She ended up paying hundreds of dollars because she couldn't prove the plates had been turned in. Go to the garage that has the plates and demand to see proof that your plates were turned in.

Frankly if someone else is using those plates it was either an employee there or someone has sold your old plates. Hope to see you back here soon. In the meantime I have a Valentine for Woogie.

There is a case currently happening in Florida involving a law enforcement officer in which a video taken at the headquarters actually shows her dumping a paraplegic from his wheel chair onto the floor because she thought he was lying to her.

When the man told her that he was disabled and could not get up to be frisked, this deputy tilted his chair until he fell out onto the floor. She then went to checking his person to see if he may have had anything on him, such as a weapon. Several deputies then assisted her with putting the man back in the wheel chair while they laughed about this the whole time.

The disabled man has currently hired a lawyer, and the deputy has recently turned herself in on charges that were filed against her.

As for myself, I have had a few problems with officers from the Orlando Police Department and the Orange County Sheriffs Department. And what makes me mad is how they give a law abiding citizen a hard time over something while these hardened criminals are still walking around making the street unsafe.

I am sorry to hear about your misfortune, and it sounds to me like as if this officer had their mind made up as to what to do before you even presented them with your story and any facts/evidence.

It is a shame that some people in this country are considered guilty until they are found innocent.

Wow Prankster, so sorry to hear of your wrongful incarceration. You definitely have a case my friend and I would pursue it. This world is a F*&ked up place sometimes. Arresting innocent people and letting the dangerous criminals go free. That's just messed up.

This is craziness. Can you get some mojo charms or
have someone do a cleansing ceremony on you? Did you
break a mirror in the last 7 years or walk under a ladder one day?
This has to stop. I agree with Sher. Go find the proof you need
that the plates were either destroyed or resold so you can start
building evidence for your case. Oooo?! Better...

Go to the local news station and
make some noise about the incident (after consulting your lawyer of course).
Get some press. Let the newsroom know that this is something the public needs
to be informed about safe guarding themselves over!
That's what criminals need... someone to catch on and devise a way
to make old license plates a hot commodity.
GREAT! A new criminal commodity... something else we need to protect
earnestly! Add it to the list of social security numbers, identity/passports,
and NOW old license plates!

Prank - I am sorry this has happened to you.
Now go find a healer to sage you.

My apologies to you, and everyone, for my tardy reply but I was advised to shut my mouth for at least few weeks until my legal situation got sorted out.

I am starting to exhale without looking over my shoulder now that all the charges have been officially dropped. My lawyer fees will be paid by the parties who erred, but it looks like it will take a little while to get that negotiated and yes, I do like the sound of Prankville. I hope you can come by and visit soon. February was a long month but now I can go out and play, even leave the state if I want to. Although no promises were made that I would be let back in...

There is always a tension in any society or culture to balance the rights of an individual against the greater good. In my case, those who had discretion took a by the numbers approach. A report was made, the tags were still listed in the DMV as belonging to me. So a visit to my home may have seemed like a logical way to keep a drunk driver off the road to some. Of course, I was assumed guilty before I even opened the door to my home and allowed the officer inside. And that's the core issue, even though I had facts to back up my position and clearly stated that in a non-threatening manner to the officer. She decided to call for back-up since she considered my use of facts and reason to be resisting arrest. The arrest report had contradictory statements from the CSP officer and the Sheriff's Deputies who provided back up which further supported dropping all charges. I hope she gets some training so she can do a better job and not repeat her mistake.

I was fortunate in many respects, I could afford legal counsel experienced in these issues, apparently a lot of people in Colorado get dragged out of their homes on charges real and bogus. At least enough to support a few good lawyers who specialize in it. I will never get back my "lost weekend" but I expect my lawyers bills will be paid by those who caused them to arise in the first place. The best news of all is that I am now free as a bird. It feels really good.

I wish I had spoken with your Dad before this all happened, chanda. Man, it would saved me a ton of trouble. But I am now officially back in the game of life with no restrictions on my movements and behaviors.

Your Dad was right on the money, if your license plates are no longer needed then destroy them. Do not think someone else will take of that for you, they just might not as I have learned.

I no longer have any legal issues outstanding. I can travel freely and enjoy a Guinness without violating anything.

Thank you for your kindness and support. It helped me a lot to know that my many friends from all over have sent me such sweet vibes. It kept my heart strong and my mind focused.

Please pass along my best wishes to Buffalo Rob. I know the Sabers are clawing their way into the playoffs. The Avalanche are on the bubble too but we are 3 points from the division lead and it looks good. Having Forsberg and Foote back has been awesome so far.

Dropkick Murphys were massive last night at the Fillmore. A couple of good openers too but I forgot their names....

Thank you, Secret, February was like a Kafka novel to me. Anonymous people saying things that were not factual and law enforcement acting as if my guilt was a foregone conclusion. I see this mirrored in a lot of ways in our society. Our legal system says guilt must be proven in a court of law beyond a reasonable doubt yet I was treated like I was convicted by the legal system at every step. Law enforcement officers have a difficult job and have to make a lot of judgment calls -- not every decision will be perfect. While anonymous tipsters have helped law enforcement, it is important to have facts and real evidence before assuming probable cause.

That being said, I can now travel freely, drive a car and consume a beer or a margarita legally again. Yee-haw, just in time for Frozen Dead Guy Days up in the mountains near Nederland. This year's event should be the best ever!

I appreciate your kind words and outrage over this unfortunate event. May your March 6th be truly fine and that Spring is making an appearance. I can feel it rising out this way, for sure...

Thank you for your friendship and support, Miss Lou. The past month has been a difficult time but most of the hassle is now over. There are certain financial issues I had to deal with due to this unfortunate incident and it appears I will be getting some compensation for that. However, my time and peace of mind were both greatly impacted for no good reason ultimately.

One lesson I learned is to always get your license tags off of a vehicle if you are disposing off it. That's the only way to be sure, no matter how much you trust the shop that is totaling out the vehicle. If I had the tags, mangled and torn, in my possession I may have been able to stay home on Feb. 1 instead of an all expenses paid weekend at the County Jail in Brighton. Still, truth and reason won out in the end and that all the matters.

I hope you are having some sunshine today, we had a little snow earlier in the week but it's starting to feel like Spring.

Sherry, you are so right about the license plate thing. My old plates are now officially off the books. If they are out there, then all law enforcement will assume they are stolen once they call the digits in. They even offer to grind old plates up at the DMV, for free, assuming you can wait in line for 3 hours. Still, it beats a stay at the Adams County Jail for the weekend by a mile. Thanks for the kind words.
